Recently my office has handled a slew of post conviction proceedings for people that were arrested and convicted of crimes as long as 20 years ago. While we are not sure if this shows an upward trend in enforcement by INS, but it's important a client, who, even with residency status, can be deported at any time with a felony conviction. When considering whether to accept a plea if you were not born in the United States, make sure you get a thorough evaluation from an immigration attorney. Deportations do happen and can strike you at any time. We have even seen aggressive deportations with certain classes of misdemeanors.
Fortunately for most of our clients we have a high success rate in overturning pleas, sometimes decades old, allowing our clients to remain in the only country they know. If you are going to plead to a crime and were not born in the US, my office always recommends that you also get a full immigration evaluation.
